Amendments to the Solicitors Act and New Regulation to take effect July 1, 2021

The Ministry of the Attorney General has advised the OBA that amendments to the Solicitors Act relating to contingency fees are now scheduled to come into force on July 1, 2021. The Order-in-Council has not yet been posted online, but please see a copy of the notice here.   A new regulation made under the Act, O. Reg. 563/20: Contingency Fee Agreements, also comes into force as of July 1, 2021, and includes provisions that contingency fees are not to exceed the amount of the award or settlement (including costs), must exclude certain disbursements, as well as other key requirements for lawyers who are engaging in contingency-fee based legal work.
